Lahore High Court orders immediate release of Sanam Javed from jail
The judgment said that repeatedly naming the petitioner in a similar case shows malice
Lahore High Court has issued the written decision on the petition against the arrest of Pakistan Tehreek-e-Insaf (PTI) activist Sanam Javed.
In a written decision, the Lahore High Court ordered the immediate release of Sanam Javed from jail. A 2-member bench headed by Justice Asjad Javed Gharal issued a 14-page written decision.
The judgment said that repeatedly naming the petitioner in a similar case shows malice, the purpose of repeatedly arresting the petitioner after her release is to defeat the judicial system.
In the written decision, it was said that the Deputy Commissioner Lahore and Gujranwala issued orders for the detention of the petitioner despite being in jail. The courts should also keep the fundamental rights given in the constitution in front while giving remand.
The court directed to send a copy of the verdict to the judicial officers, IG and all deputy commissioners.
The judgment said that the investigating officer had no evidence to name the petitioner in the case, the case was registered against the petitioner in Gujranwala on the basis of malice, the petitioner is discharged from the case forthwith.
The Deputy Prosecutor General stated that no case has been registered against Sanam Javed.
